The Supreme Court of India is reconsidering the legality of polygamy under Muslim personal law after activists challenged its exemption from criminal law punishing bigamy.

The petitioners argue this exemption violates constitutional equality rights, seeking criminalization of polygamy and compulsory marriage registration. The Court is examining whether polygamy, like instant Triple Talaq, should be struck down for violating gender justice.

The case questions religious freedom, constitutional mandates, and the essential religious practice of polygamy, potentially redefining personal laws in favor of uniform civil code principles.
