A wife's love and affection for someone other than her husband does not constitute adultery unless it involves a physical relationship, Madhya Pradesh High Court noted in its recent ruling.
The verdict was delivered by Justice GS Ahluwalia, who asserted that adultery, by definition, necessitates sexual intercourse, Bar and Bench reported.
The High Court made the observation while hearing a revision petition filed by a man against a family court's order. The man contended that since his wife was in love with another man, she was not entitled to maintenance.
However, the court dismissed his petition, reaffirming that mere emotional involvement does not amount to adultery.
