Case on Removal of Sivalingam at Jaffna Hindu College Ordered to Proceed for Hearing

A Fundamental Rights petition filed by three petitioners against the removal of a Sivalingam that was duly consecrated at Jaffna Hindu College in 2018 was taken up before the Supreme Court on January 23. 

The petition alleges violations of Articles 10, 12(1), 12(2), 14(1)(e), and 14(1)(f) of the Constitution by the first respondent, the current principal of the college.

The case was heard before Chief Justice Padman Surasena and Supreme Court Justices Achala Wengappuli and Menaka Wijesundara. The Court decided to grant leave to proceed with the hearing.

The petitioners argue that the removal of the consecrated Sivalingam and subsequent attempts to reinstall it at another location constitute a violation of their fundamental rights.

The case has been fixed for hearing on 3 July 2026.

Senior Counsel K.V.S. Ganesharajan appeared for the petitioners with Attorneys Vidusha Lokanathan and Mangaleswari Sankar. Dr. Guruparan, Attorney-at-Law, appeared for the first respondent, while the Attorney General appeared on behalf of the second to seventh respondents.
