DNA tests require legal justification, not mere demand: Karnataka High Court

The Karnataka High Court has set aside a trial court order permitting a DNA test, cautioning that such directions must be issued strictly in accordance with law and only when absolutely necessary, keeping in mind the constitutional right to privacy and dignity.
Justice M Nagaprasanna delivered the judgement while quashing the order passed by a civil court at Channarayapatna in Hassan district, which permitted a DNA test in a partition dispute.
Emphasising the “delicate balance” involved, the High Court reiterated the Supreme Court’s warning that compelling DNA tests without imminent need can imperil the sanctity of marriage, the legitimacy of children, and fundamental rights under Article 21 of the Constitution.
